Can small development companies use community edition for development? or its not allowed to use because its stated that companies opting out of bizspark membership can use community

Yes you can use it... A small team up to five members can use Visual Studio Community for development, testing and publishing theri applications...

From Visual Studio Community license: "...and you are also not an enterprise (defined below), then up to 5 of your individual users can use the software concurrently to develop and test your applications."
