What error/exception are you getting? Could you give us more details about your scenario?
If you were using WCF, you could make that scenario work, as shown in: http://developers.de/blogs/damir_dobric/archive/2007/08/09/wcf-datetime-and-datetimeoffset-on-the-wire.aspx. Please consider moving to WCF if you are just starting with the development of your application.
