This is one of the reasons that "Save Site as a Template" is disabled when Publishing Infrastructure is turned on at the Site Collection level.  This changes how sub sites interact with the root site.  Since you are only copying a sub-site you can't guarantee that the changes will be there in the destination.  So copying Publishing sites is not supported.
