I've got the co-ordinates for say the head in xyz from the skeleton data and I've got the floor clip plane also given from the skeleton data. In a cartesian system i would just use a simple point-plane distance equation. Am I correct in doing this. Does it matter if the kinect is at a tilt? Is this adjusted for because the z direction is the direction that the kinect is pointing?

I think the Kinect tilt should not matter. Since the heels are always on the floor, the floor plane equation should be derived independent of the tilt. I think this reason is valid as long as a skeleton is being detected.  Your method of determining the height also should work. Please let us know your results.
