What I eventually did was replace ABP exception filter altogether. In my custom filter I could set any status code I need.

var filters = Configuration.Modules.AbpWebApi().HttpConfiguration.Filters;
var currentExceptionFilter = filters

filters.Remove(currentExceptionFilter );
