We have a requirement to migrate data from SP 2010 to SP 2013, Using Content DB attach we migrated the data to Sharepoint 2013. In that we found a major issue in the migrated data.

From you post i understand that you had migrated but there was issue with nintex now you want to only migrate those list and libraries which do not have the nintext workflows or forms etc. if thats true then here are couple of options for you.
