I'd like to know if there's a solution to this issue yet?
Or maybe it's just by design. But can anyone explain the reasoning behind it?

I will try to describe this issue in simple reproducable steps:

1. Create OOB document library and enable management of content types. By default the Document ContentType(CT) has been added.
2. Add CT A (Letter) and CT B (Note), which derives from the OOB Document CT. Add also the OOB Document Set CT.
3. Change the new button order and make CT A the default CT of this document library. The order in which the content types display on the new button is now:
   Letter, Document, Note and Document Set.
4. Edit the Document Set CT settings. You'll notice that Document CT is the only allowed CT for this Document Set CT. Add CT B (Note). Cfr. screenshot.
   
5. As a result the only Allowed Content Types for this Document Set list content type are Document and CT B (Note)
6. Create a document set.
7. Open the document set and upload a new document.
8. This will automatically sets the Content Type to CT A which isn't an allowed CT in the Document Set. Cfr. screenshot
   

It's a common problem and many others experience this same behaviour. I've read about it in some other threads on the msdn forum and on the internet.

It wouldn't be such a huge problem if you could bulk edit these documents in order to change their content type. But unfortunately there's only one way to achieve this. By adding the Content Type column as first column in your view and using the Datasheet View option.
Even then you better have a list of all your content types in the vicinity since you cannot choose them from a dropdown and have to type them yourself.

Another option is to resort to 3rd party software which overcomes this issue and present you only the allowed content types to choose from upon upload. (E.g. OnePlaceMail,...) Most of these tools also provide multi-upload functionality.

But I find it hard to convince customers to buy additional software just for that.
