Please take a look at the reply from Carmine Si - MSFT  in the following thread

Kinect for Xbox 360 will not work in commercial deployment and is not supported. The SDK can be used with the Xbox 360 sensor only for development purposes, but is limited in the feature set. This is covered in the FAQ under the "Developer Questions" section
